Dedicated Drug Crime Attorney Defending Redwood City & San Mateo County
In the state of California, drug laws generally fall into two broad categories: simple possession and possession with the intent to sell. With the softening of attitudes lately, both in California and throughout the United States, the California Health and Safety Code also separates offenses related to controlled substances classified as narcotics or “restricted dangerous drugs” from offenses related to marijuana. Additionally, the state of California has also established separate offenses related to PCP and methamphetamine.
Penalties for drug possession vary depending on the type of drug, the amount possessed and the purpose for which the accused had possession of the drug. Possession of an illegal narcotic can lead to a sentence of imprisonment in county jail for up to one year, while possession with the intent to sell may result in a sentence of imprisonment for anywhere between two and five years. Penalties are especially severe if the defendant has been charged with possession and transport of a controlled substance from one county to another.
Typically speaking, a defendant in possession of less than one ounce of marijuana faces a fine up to $100. The state can impose additional fines and/or terms of imprisonment in county jail for various circumstances, including possession of an amount greater than 28.5 grams and/or possession in close proximity to a school or government building. If accused of the latter, you may be looking at a prison sentence ranging anywhere from 16 months to three years.
First Things First
If state’s evidence was obtained from an illegal search, the court will not allow its use in the case against you. If you were charged with a non-violent drug possession offense, relief available to those who qualify includes Drug Court, Deferred Entry of Judgment and Proposition 36. If you have a drug habit that contributed to your legal problem, your answer may lie in obtaining residential drug treatment.
